Our official policy is that KickStart does not accept returns for purchased items except for in cases of shipping damages or Warranty issues as described below.
In the interest of maintaining good relationships with our clients, however, we do consider every return/exchange request on a case by case basis, especially with multi-piece or fitness room purchases. Please do not hesitate to contact us immediately with any issues related to the equipment or products we provide. Your satisfaction is always our primary concern, and we will always do our best to ensure a positive result.
In any case, all returns or exchanges must be shipped back freight prepaid and must arrive in like new condition.
Shipping Policy for
Returns or Exchanges
In general, the purchaser is responsible for shipping costs for any type of return or exchange. Where appropriate, KickStart may, at our sole discretion, assist with shipping costs in some situations.
Occasionally a fitness product may be damaged in the shipping process. This may be true even though the exterior of the box may show no damage (placement of a heavier item on your bike may cause fenders and light frames to twist or bend). KickStart cannot be responsible for damages caused by the shipping process. We will, however, always work to resolve any shipping-related damage issues.
IT IS IMPERATIVE THAT PURCHASERS OPEN AND ASSESS EQUIPMENT UPON RECIEPT WHILE THE CARRIER REPRSENTATIVE IS STILL PRESENT. DAMAGES/SHORTAGES MUST BE NOTED ON THE FREIGHT BILL ALONGSIDE OR PROXIMATE TO YOUR SIGNATURE. YOU SHOULD ALSO NOTE DAMAGES/SHORTAGES FOR YOUR OWN RECORDS. THIS IS THE ONLY WAY TO ENSURE THAT DAMAGES INCURRED DURING SHIPPING WILL BE RECOGNIZED BY THE CARRIER.
KickStart offers a multitude of products from various manufacturers. As a reseller, KickStart does not offer or provide Warranties for any equipment sold. ALL equipment is subject exclusively to the manufacturer’s Warranty. We will provide you with specific manufacturer’s Warranty information for any equipment you purchase from us. If you have questions about the Warranty for any equipment, please contact us via phone or email and we will be happy to provide you with this information.
Should a Warranty related issue arise, please do not
hesitate to contact us. We will facilitate your claim with the manufacturer
and do our best to resolve the situation to your satisfaction.
Most manufacturers offer substantial
Warranties for structural components, and are generally reasonable about
handling Warranty issues.
Manufacturer’s Defects Policies
We work closely with our manufacturers to resolve the rare instances of manufacturing defects. If a product appears to have a manufacturing defect, please email us the details along with JPG or GIF pictures, if possible (email your Account rep or accounts@kickstartfitness.net). We will respond within 3 days advising you as to the status of your issue. Please do not return Items to us without receiving instructions. Returned items will be shipped directly to the manufacturer unless otherwise indicated by KickStart.
Order Cancellations
and Modifications
Any order cancellations or modifications must be made by
phone within one business day of placing the order by calling our sales
department at 1 (866) 954-5425 Mon-Fri 8:30AM to 5:00PM PT. Cancellations or
Modifications cannot be made by email or fax. You will be responsible for
freight charges if you wish to cancel an order that has already been
shipped.
For large equipment and/or multi-piece orders, KickStart generally coordinates delivery times and dates between the purchaser, the manufacturers, and the various Carriers. We may also, for fitness rooms or larger installations, arrange for unloading equipment such as forklifts, hand-trucks, etc (evaluated on a case by case basis) KickStart reserves the right to ship all orders at our discretion. Items may be shipped from a KickStart location and/or drop-shipped from a manufacturer location. Delivery times will vary and we strongly encourage you to contact us regarding estimated delivery times. Normal delivery time for MOST items is between 4-6 weeks; but delivery times may be longer, especially around holidays and peak shipping seasons. The freight delivery service you receive may vary from one carrier to another. All small orders will be shipped via UPS, USPS, or FedEx Ground. All larger orders will be shipped via Common Freight Carrier.
Be sure to include two contact numbers and an email address so that KickStart or Carrier can contact you to schedule a delivery date. It is the responsibility of the purchaser to have appropriate personnel for receipt of goods, and access to facilities, on the delivery date. The delivering company is generally responsible to bring the equipment to the end of the truck only. It is the customer’s responsibility to remove the equipment from the truck and into the facility.
IT IS THE RESPONSIBILITY OF THE PURCHASER TO THOROUGHLY
ASSESS THE CONDITION OF RECEIVED GOODS WHILE THE CARRIER REPRESENTATIVE IS
ON-SITE. When the Carrier delivers your order, count the pieces you receive
and look for any noticeable damage. If
the number of pieces you receive does not exactly match the number of pieces
on the freight bill, note the number you received on the freight bill by
your signature. If you see any visible damage to the equipment note that on
the freight bill next to your signature. Neither
KickStart nor the freight carrier can be held responsible for shortages or
damages if you do not note them on your freight bill.
All damage and shortage claims must
be filled with the freight carrier; KickStart can assist with this as long
as you have noted the shortages/damages upon receipt.
KickStart Fitness
Website Disclaimers and Limitation of Liability
The KickStart Fitness site is provided on an "AS IS," "as
available" basis. Neither KickStart nor its affiliates, subsidiaries, or
designees nor each of their respective officers, directors, employees,
agents, third-party content providers, designers, contractors, distributors,
merchants, sponsors, licensors or the like (collectively, "associates")
warrant that use of the KickStart Fitness site will be uninterrupted or
error-free. Neither KickStart Fitness nor its associates warrant the
accuracy, integrity or completeness of the content provided on the KickStart
Fitness site or the products or services offered for sale on the KickStart
Fitness site. Further, KickStart Fitness makes no representation that
content provided on the KickStart Fitness site is applicable or appropriate
for use in locations outside of the United States. KickStart Fitness
specifically disclaims warranties of any kind, either expressed or implied,
including but not limited to warranties of title or implied warranties of
merchantability or fitness for a particular purpose. No oral advice or
written information given by KickStart Fitness, nor its associates, shall

Under no circumstances shall KickStart Fitness or its
associates be liable for any direct, indirect, incidental, special or
consequential damages that result from the use of or inability to use the
KickStart Fitness site, including but not limited to reliance by a user on
any information obtained at the KickStart Fitness site, or that result from
mistakes, omissions, interruptions, deletion of files or email, errors,
defects, viruses, delays in operation or transmission, or any failure of
performance, whether or not resulting from acts of God, communications
failure, theft, destruction or unauthorized access to KickStart Fitness
records, programs or services. The foregoing Limitation of Liability shall
apply whether in an action of contract, negligence or other tortuous action,
even if an authorized representative of KickStart Fitness has been advised
of or should have knowledge of the possibility of such damages. User hereby
acknowledges that this paragraph shall apply to all content, merchandise and
services available through the KickStart Fitness site. Because some states
do not allow the exclusion or Limitation of Liability for consequential or
incidental damages, in such states liability is limited to the fullest
extent permitted by law.
Prices and availability are subject to change without
notice. Errors will be corrected where discovered, and KickStart Fitness
reserves the right to revoke any stated offer and to correct any errors,
inaccuracies or omissions including after an order has been submitted and
whether or not the order has been confirmed and your credit card charged. If
your credit card has already been charged for the purchase and your order is
cancelled, KickStart Fitness will issue a credit to your credit card account
in the amount of the charge. Individual bank policies will dictate when this
amount is credited to your account.
While KickStart Fitness takes steps to ensure the accuracy
and completeness of product and third-party services provided, please refer
to the originator of information for details, for example the manufacturer
for complete product details.
Quantities May be Limited KickStart Fitness may, at its
own discretion, limit or cancel quantities purchased per person, per
household or per order. These restrictions may include orders placed by the
same KickStart Fitness account, credit card, and also orders which use the
same billing and/or shipping address. Notification will be sent to the
e-mail and/or billing address provided should such change occur. We reserve
the right to limit the quantities sold, including the right to limit or
prohibit sales to dealers.
Content included on or comprising the KickStart Fitness
site, including information, data, software, photographs, graphs, videos,
typefaces, graphics, music, sounds and other material (collectively
"Content") are protected by copyrights, trademarks, patent or other
proprietary rights, and these rights are valid and protected in all forms,
media and technologies existing now or hereinafter developed. All Content is
copyrighted as a collective work under the U.S. and international copyright
laws, and KickStart Fitness owns, to the fullest extent allowed by such
laws, the copyright in the selection, coordination, arrangement, and
enhancement of such Content. Except as expressly authorized or licensed, you
may not copy, modify, remove, delete, augment, add to, publish, transmit,
participate in the transfer or sale, lease or rental of, create derivative
works from or in any way exploit any of the Content, in whole or in part.
The KickStart Fitness logos and other trademarks on the
site are the property of their respective owners and are owned by, licensed
to, or, where required, used with permission by KickStart Fitness and may
not be reproduced, copied, or manipulated in any manner without the express,
written approval of the trademark owner.
KickStart Fitness does not want to receive confidential,
proprietary or trade secret information through the KickStart Fitness site
(excluding information relating to any order you submit). Please note that
any information, materials, suggestions, ideas or comments sent to the
KickStart Fitness site will be deemed non-confidential, and, by submitting
any such information, you are granting KickStart Fitness an irrevocable and
